Saxon Gilmore filed a case in the United States District Court, Middle District of Florida, Tampa Division on behalf of the plaintiff concerning an alleged debt being collected by First Bank of Delaware, a Delaware Corporation arising from an alleged debt for a different individual.
The complaint in the above-styled case alleged violations of the 15 U.S.C. § 1692 et seq., the Fair Debt Collection Practices Act (the"FDCPA"), Florida Statutes 15 U.S.C. § 1692k(a)(1); statutory damages pursuant to 15 U.S.C. § 1692k(a)(2)(A); and, reasonable attorneys' fees and costs pursuant to 15 U.S.C. § 1692k(a)(3). The plaintiff contacted First Bank of Delaware and demanded that they cease and desist from communicating with him in regards to collection of the alleged debt for the other person. First Bank of Delaware ignored the plaintiff's request and continued to call and harass the plaintiff.
The matter settled prior to trial.
